1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NurGuide Ai ("NurGuide Ai," "we," "us," or "our"). By accessing or using the NurGuide Ai mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms in their entirety. If you do not agree, you must immediately cease all use of the Service.

Your continued use of the Service after any modification to these Terms constitutes acceptance of the updated Terms.

2. Nature and Purpose of the Service

NurGuide Ai is an AI-powered Islamic educational platform designed exclusively to support personal learning and reflection. The Service provides general educational content derived from publicly available Islamic sources, including but not limited to the Qur'an, Hadith collections, classical fiqh literature, scholarly commentary, and the Sunnah of the Prophet Muhammad (peace be upon him).

THE SERVICE IS STRICTLY EDUCATIONAL IN NATURE. It is not a religious institution, scholarly body, or authority of any kind. The Service does not and cannot:

  • Issue fatwas (Islamic legal rulings) of any kind
  • Provide binding religious determinations, verdicts, or authoritative decisions
  • Replace or substitute qualified Islamic scholars, muftis, or imams
  • Represent any specific madhhab (school of jurisprudence), sect, or theological movement
  • Serve as a mufti, imam, religious counselor, or religious institution
  • Provide personalized religious guidance tailored to your specific circumstances

3. Critical Disclaimer Regarding AI-Generated Content

THE SERVICE USES ARTIFICIAL INTELLIGENCE TO GENERATE RESPONSES. AI-generated content is automated and carries inherent limitations. You expressly acknowledge and agree that:

  • AI responses may contain inaccuracies, errors, omissions, misattributions, mistranslations, or incomplete information
  • AI responses are not reviewed in real time by qualified scholars or religious authorities
  • AI responses may fail to capture the full contextual, historical, or jurisprudential nuance of Islamic sources
  • AI responses may present one scholarly opinion where significant disagreement exists among scholars
  • AI responses regarding Hadith authenticity and grading may be incomplete or imprecise
  • AI responses may not account for abrogation, conditions, exceptions, or principles of usul al-fiqh

ANY LANGUAGE IN AN AI RESPONSE THAT APPEARS DEFINITIVE OR AUTHORITATIVE SHOULD BE UNDERSTOOD SOLELY AS AN EDUCATIONAL SUMMARY, NOT AS A BINDING RELIGIOUS DETERMINATION OR SCHOLARLY RULING.

4. Mandatory Verification Requirement

You agree that you will independently verify all content provided by the Service, particularly but not limited to the following matters:

  • Qur'anic verses, translations, and interpretations
  • Hadith references, chains of transmission, and authenticity grading
  • Matters of marriage, divorce, and family law
  • Inheritance and estate distribution (miraath)
  • Zakat calculations and eligibility
  • Islamic finance, contracts, and permissibility of transactions
  • Personal religious decisions and acts of worship
  • Legal disputes and contractual matters
  • Medical, health, or safety-related matters

For any of the above matters, you are strongly required to consult a qualified scholar, imam, or recognized Islamic authority before acting.

5. Zero Knowledge Architecture and Data Privacy

NurGuide Ai is built on a Zero Knowledge Architecture. This means:

  • All conversations and AI interactions are processed and stored locally on your device only
  • No conversation data is transmitted to or stored on NurGuide Ai servers
  • A summary of each conversation is automatically saved to your device at the end of each session
  • You may optionally back up summaries to Google Drive (Android) or iCloud (iOS) at your own discretion
  • NurGuide Ai has zero access to your conversation content at any time
  • Uninstalling the app will permanently delete all locally stored conversation data

You are solely responsible for managing your local device data and any cloud backups you choose to enable. NurGuide Ai is not responsible for any data loss resulting from device failure, app uninstallation, or third-party cloud service issues.

6. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18 years of age, you represent that you have obtained the consent of a parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet the applicable eligibility requirements.

7. User Accounts

If the Service offers account creation, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

8. User Content and Submissions

You may submit questions, prompts, and other content ("User Content") to the Service. You retain ownership of your User Content. By submitting User Content, you grant NurGuide Ai a limited, non-exclusive license to use your User Content solely to the extent necessary to operate, maintain, improve, and secure the Service, consistent with the Privacy Policy.

You agree not to submit:

  • Content that is unlawful, harmful, harassing, defamatory, or abusive
  • Sensitive personal data of third parties without their consent
  • Content that infringes any third-party intellectual property or privacy rights
  • Content that promotes extremism, violence, or hatred

9. Prohibited Uses

You agree not to use the Service to:

  • Request, generate, or disseminate content promoting extremism, terrorism, violence, or hate
  • Fabricate, misrepresent, or present AI-generated responses as authentic fatwas or authoritative religious rulings
  • Impersonate scholars, imams, or religious institutions, or misrepresent your credentials or authority
  • Mislead others regarding the source, authority, or nature of content generated by the Service
  • Circumvent, probe, or test the security mechanisms of the Service
  • Scrape, harvest, or collect data from the Service at scale without prior written authorization
  • Reverse engineer, decompile, or attempt to extract source code or underlying AI models
  • Use Service outputs to build, train, or fine-tune competing AI systems
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation

10. Intellectual Property

All software, design elements, branding, logos, interfaces, and proprietary content created by NurGuide Ai are owned by NurGuide Ai or its licensors and are protected by applicable intellectual property laws. The Qur'anic text itself is divine revelation and not subject to copyright; however, specific translations, commentary, and compilations may be subject to third-party copyright.

The Service grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes only. You may not copy, reproduce, distribute, or commercially exploit any content from the Service without prior written authorization.

11. Third-Party Services

The Service may integrate or link to third-party services, including authentication providers, prayer time APIs, location services, analytics providers, and cloud storage platforms. NurGuide Ai does not control third-party services and is not responsible for their content, availability, or practices. Your use of third-party services is governed by their respective terms and privacy policies.

12. Payments and Subscriptions (If Applicable)

If the Service includes paid features, you agree to the pricing and billing terms presented at the time of purchase. Payments may be processed by third-party platforms such as Apple App Store or Google Play Store and are subject to their terms. Except where required by applicable law, all fees are non-refundable.

13. Modification and Discontinuation of the Service

NurGuide Ai reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee the continued availability of any feature or content.

14. Termination

NurGuide Ai may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, engaged in unlawful conduct, or posed a risk of harm to other users or to NurGuide Ai. You may discontinue use of the Service at any time. Upon termination, all rights granted to you under these Terms immediately cease.

15. DISCLAIMERS

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NurGuide Ai EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND TITLE.

NurGuide Ai DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) OUTPUTS WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR NEEDS; (C) ANY DEFECTS WILL BE CORRECTED; OR (D) THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS.

NurGuide Ai EXPRESSLY DISCLAIMS ANY WARRANTY THAT AI-GENERATED CONTENT CONSTITUTES ACCURATE, COMPLETE, OR AUTHORITATIVE RELIGIOUS GUIDANCE.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NurGuide Ai AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM RELIGIOUS MISGUIDANCE, MISUNDERSTANDING, MISINTERPRETATION, MISATTRIBUTION, OR RELIANCE ON AI-GENERATED CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. TO THE EXTENT SUCH EXCLUSIONS OR LIMITATIONS ARE NOT PERMITTED UNDER APPLICABLE LAW, THEY SHALL APPLY TO THE FULLEST EXTENT PERMITTED.

17. Indemnification

You agree to indemnify, defend, and hold harmless NurGuide Ai and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising from or related to:

  • Your access to or use of the Service
  • Your User Content
  • Your violation of these Terms or any applicable law
  • Your reliance on, misinterpretation of, or misuse of any output from the Service
  • Your representation or presentation of AI-generated content as authoritative religious guidance
  • Any religious, personal, financial, legal, or other decisions made based on Service outputs
  • Your interaction with other users or third parties in connection with the Service

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or the Service shall be resolved under applicable U.S. jurisdiction. You consent to personal jurisdiction in the applicable courts.

OPTIONAL ARBITRATION: If you prefer binding arbitration, replace the above with an arbitration clause appropriate for your jurisdiction, including applicable class action waiver provisions. Consult qualified legal counsel before implementing.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice within the Service or on our website. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.

20. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy and any additional policies posted within the Service, constitute the entire agreement between you and NurGuide Ai with respect to the subject matter herein.
